Wisconsin Supreme Court Rules Drop Boxes and Ballott Harvesting Illegal

Supporters call decision a "victory for election integrity."

State officials in Wisconsin went beyond their authority by permitting ballot drop boxes in the 2020 election.

In a 4-3 decision Friday, justices at the Wisconsin Supreme Court upheld a lower court ruling that absentee ballots must be delivered by mail or in-person to a local clerk’s office or designated alternate site.

However, the court did not rule on whether voters can have someone else handle their ballot on its way to a mailbox, according to reports.

Wisconsin Supreme Court Justice Rebecca Bradley authored the majority opinion and said the Wisconsin Elections Commission (WEC) did not have the authority to authorize drop boxes.

“Only the legislature may permit absentee voting via ballot drop boxes,” Bradley wrote. “WEC cannot. Ballot drop boxes appear nowhere in the detailed statutory system for absentee voting.”
